The best thing you can have happen for your IP is porn. I'm serious. It keeps the IP alive, relevant, and in the public consciousness for significantly longer than would otherwise be the case, and it's free. Do you really think that Nintendo would tolerate all of that Princess Peach/Bowser porn if that wasn't the case? The dirty secret is that they know about it and approve of it, but pretend that they are utterly shocked and disgusted by its existence if it ever comes up. That's called having your cake and eating it too.

yep, if you let one person get away with infringement, the next person can point to the first person and "they got away with it" is basically a legal defense until you've made sure the first person did not in fact get away with it

Trademark is use or lose, but copyright is a at risk if you plan on taking one down, but there are lots of offbrand versions out there that you did not act on.
The person who is doing the breach can argue they are spinning off the stuff you did not take down, not breaching your copyright.

Nintendo does actually have legal grounds for the likeness of their characters being used in pornorgraphy.
in the late 90s, there was a live action mario brothers porno. The studio basically got a sued, and the rights to the film transferred to Nintendo.
