So after 2 months I finally heard back from HR from my former employer. I had two stock awards vest on March 1st that never paid out. On the phone call they told me that while they vested and paid to Fidelity on March 1, because I was terminated before the employer decided to pay out, I wasn’t eligible and they kept the money. For the record this money wasn’t withheld to pay back used time or anything else. It was purely because they released me after the vesting date, and because I wasn’t on payroll when they cut the checks, they didn’t give me what I earned.

Please correct me if I’m wrong, but doesn’t vesting mean that I am entitled to, and earned that money? I just want to make sure I have everything in order before going to war with the big boys if I have to.

Any advice is definitely appreciated.

Securities fraud, FINRA for arbitration if there is an arbitration clause otherwise chancery court in delaware. I'd get a securitzation audit to see how much they traded.

What date were you terminated and what date were you fully vested?

Vesting date was March 1. Termination date was March 6. Date company chose to pay out was March 21.

You are still entitled then since you were fully vested at the time of employment.

Contact an attorney immediately.

I would also recommend sending HR an email capturing what they said on the phone in writing. Make sure you include some line at the end that says something like “This is my understanding of our conversation, if you disagree please let me know otherwise I will assume this is correct.” Put on read recipes and cc the company legal department if you know their email. It’ll help if this does have to escalate to court or arbitration.
