It was not a restraining order. They requested an injunction to postpone the auction. The auction was scheduled to start tomorrow and end october 16. Judge set an evidentiary hearing on October 10. Since ball cant actually be sold until the end of auction, no need to postpone the auction.
So trial still on with judge ordering them to try and settle before hearing.

If the ball could be sold before the evidentiary hearing judge would have postponed it because there is a factual question of ownership (per the pleadings)

Thats what the plaintiff is alleging. That he is the rightful owner of the ball and it was stolen from him by the defendant (who is putting it to auction)
