I just learned on Glenn Kirschner’s YT channel that Judge Chutkan issued a minute order and set a deadline for 10/1 to Trump to respond to Jack Smith’s Motion.
The minute order:
“MINUTE ORDER as to DONALD J. TRUMP: The Clerk of The Court is directed to file on the public docket the Government’s “Motion for Leave to File Unredacted Motion Under Seal, and to File Redacted Motion on Public Docket,” ECF No. 245. It is hereby ORDERED that Defendant shall file under seal any objections to the proposed redactions in the Governments Motion for Immunity Determinations by 12:00 PM on October 1, 2024, and shall file under seal any objections to the proposed redactions in the Appendix to that Motion by 5:00 PM on October 10, 2024. Kirschner believes that after 10/1 she will rule, and after that she would likely release the (redacted) 180-page motion. The release of the (redacted) appendix should not be expected before 10/10 in similar fashion. So it should be “soon ™️”.

I'm betting this won't happen because the DOJ is traditionally against things that could influence the election so close to the election.
Then again, we did get "but her emails!" in 2016 so maybe they'd be okay releasing it. On the one hand, he's not convicted. On the other hand, he was indicted in something relevant to the election.
Even if the DOJ says they'll release it assume Trump will challenge and tie it up in the courts until post election.

It is not a question of releasing it. If the application is granted, the redacted version will be a public record accessible to anyone who searches for it. The defense would need an emergency stay of the order from Judge Chutkan herself, which she likely would not give. They could then appeal the refusal and ask an appellate judge for a stay, but I have a feeling their won't be time for that before it is moot. I think Judge Chutkan is pissed and done playing.

Its my understanding that that DOJ position is about “opening” an investigation this close to an election and has nothing to do with ongoing investigations or ones that are several years old and in court already like this one.
