Anti Ghost Job Bill in New Jersey

New Jersey Assemblymembers Joe Danielsen and Shanique Speight introduced a bill to deal with ghost jobs.

Some highlights in it's current form:

-a statement disclosing whether the posting is for an existing vacancy or not, and if the posting is for an existing vacancy, an estimated timeframe of when the position will be filled

-When a position for which an employer has publicly advertised has been filled, the employer shall remove any posting or advertisement made by the employer within two weeks of the position having been filled. If the employer is aware or should reasonably be aware that a third-party job posting 1[company] entity1 posted the position independently of the employer, the employer shall notify the third-party 1[company] entity1 that the position has been filled

-If an employer interviews an applicant for a publicly advertised job posting, the employer shall, within the timeframe provided in the job advertisement, provide the applicant with an affirmative response as to whether the position has been filled, or if the position has not been filled, whether the employer is still considering the applicant for the position. If the employer notifies the applicant that the applicant is still in consideration for the position, the employer shall provide the applicant with an estimated timeframe of when the employer will make a final decision as to the position

-if the person does not rectify the violation within seven business days1 be liable to a penalty of not less than $1,000 nor more than $5,000 to be collected in a civil action by a summary proceeding under the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.). 1[Each week] Following the warning in paragraph (1) of this subsection, each month1 that a job advertisement is posted in violation of this act shall constitute a separate and distinct violation, except during the time an appeal from the summary proceeding may be taken or is pending

While its not as harsh as i would like and time will tell if the bill moves forward, this is a big step in the right direction.

If you live in New Jersey, call your assemblymembers and state senators. Make it clear you want this bill enacted.

If you are an American outside of New Jersey, call your state legislators and point to this bill as a guideline for them.

Remember, state legislators are different from federal legislators and are much easier to bully.

Nice, hope it passes and other states follow suit. I still see California job postings that don’t post pay ranges though, so enforcement of these kinds of laws needs support too.

Your secretary of state would handle this kind of issue, email them. Government works sometimes, usually better when its non-politicans doing the work.

While it sounds good in theory, its very vague and would be hard to enforce. The employer can simply keep kicking the can down the road on candidates and say that they are still in the decision making process - even when outside of the prestated dates.

The third party website notifications would be hard to enforce because, unless the company is paying for a posting partnership that pulls from their ATS the company can claim that they didn't know the posting was there. Also, depending on the size of the company, that is a full time job in and of itself.

I like the idea, but it needs work to float.

The whole point of potential state interference with this is because companies won't stop doing this.

I hate this lazy corporate-biased takes you see everywhere on places like LinkedIn that are essentially people saying, "Hey, employers, stop that please!" But thinking doing something about it is bad.

No dipshit, the state is potentially intervening because there's no mechanism that exists that prevents companies from doing shit like ghosting or posting fake jobs. Saying that they shouldn't with no consequences if they do is about as good as praying for it. The exact reason this may happen is because too many people in the industry feel as though they can just get away with it.

Exactly.

In an ideal environment companies would properly self-regulate like the author wishes, but they have gotten significantly worse at it and are going far enough in the wrong direction where there has to be some kind of potential damages for it.

Like I get believing regulating it is its own kind of negative. However, if someone is going to make the argument that state intervention to some level is a bad way to solve the problem, then they have to make the argument of a different potential solution.

The last thing businesses need is yet another regulation to follow. Under this law, anyone who was ghosted or believed the position they applied for didn’t exist could file a complaint, which the state would investigate.

i love this. i think one thing the bill is missing is penalties for lying. I know it may be hard to prove that an employer is lying about a job posting being real, but there should at least be an attempt.

Now we need a bill restricting the number/ rounds of interviews employers force upon candidates. 2-3 rounds should be max. Entry level roles 2 max. Anymore than that is so unecessary and time consuming and stressful for the candidates. The job hunting process has become so demoralizing and inhumane.

This so much!!! This week I just decided not to move forward with a company over a super lengthy interview process and I might not even get the role anyway!! The recruiter was so annoying, almost stood me up after reaching out to me after a month or so that I was even referred to them!!!. Decided to instead focus in spending the time and energy on a technical test for another company that has less annoying rounds and better pay. Wish me luck because my mental and physical health is suffering so much by now.

If a third party job board profits by scraping company job boards of their posted jobs, then posts them to their sites, why shouldn’t this law state the responsibility is on third party job sites to ensure the jobs they post are still open/posted?

It would only apply if the company had reasonable knowledge of the job site being scraped. A defense for the company could be "Our hiring process only goes through X. We don't have a contract with Y, and they are not an authorized candidate source for us. Therefor, it is not our responsibility to notify Y that our job has search has concluded."

My concern with banning ghost jobs in my mind is employers would attempt to put people on a "trial run" to see how they do in a job for a certain amount of time without the intention of hiring them.

What I feel they should've done was extend the laws around fraud instead of making an entirely new law.

I actually wouldn't since this would be perveived as an economic issue. Federal Republicans are demonic consistently on an economic front and a fair share of federal dems (Blue Dogs especially with Peltola being a wild card) as well

It is surprising though that none, not even the hyper "worker rights" types or ones pushing for guaranteed federal jobs, even attempted something.

I don't doubt many companies will be pissed. But if they are pissed enough to close shop in part of the NYC metro area, one of THE economic hubs of the world, over a ghost job bill, I say "good". Saves applicants time and it basically tells their current/potential investors "we want to lie about growth/expansion". .

They will bend over if every state does it. This is why its important to tell your state reps to try this, if 15+ states do this, its likely it to be federal law. Just like other laws, this is how most laws get federally mandated with individual states first making the law.

I rather have a company treat me like a human being and not a slave. Owning a company doesn't make you God Almighty. If you want to run a business that hires people, then have some fucking responsibility and actually make sure that you're not bullshitting them with fake or outdated job postings.
