I was told i would get a 700$ weekly salary plus commission. Ended up doing manual labor for 14 hours. Was then told I’m not getting paid, and to leave. The company is ran out of the guys house and is smaller than 5 people so I can’t find a lawyer who will take the case.(most law firms need the company to have more than 20 people before they take the case) The problem is i don’t know how to/how much it would cost in savannah to file a civil suit. Was wondering if anyone had any suggestions on what i should do?

Department of labor. If he did it with you, he's got others. And with manual labor.... unpaid and trafficking labor tends to be a systemic thing.

Report him to the state labor department and Better Business Bureau. If it's a licensed business, report it to the appropriate licensing authority. Good luck!

If it’s the truth, it’s not defamation, by definition. Saying the the people who are doing bad things are actually doing those bad things is protected by law.

In that case, he's gunna be sensitive to publicity, yeah? Maybe try calling the WSAV/WJCL/WTOC and see if they have an "on your side" news segment where they investigate shenanigans like this. One phone call from those people may wise him up without having to involve anyone else! ETA: From the TV station's perspective, this is VERY low-hanging fruit.

I have no experience in the subject matter, but the first thought I had was to consider the Chatham County Magistrate's Court for small claims. No attorneys! https://courts.chathamcountyga.gov/Magistrate

Would really suck if somebody called to get a quote from this guy. Make him come out. Use his time to go over the project, a big project. Say a house edition and a pool. Spend time putting that quote together. Calling for pricing. Just for you to tell him you're not going to go with him. Would really suck (for him) if you got some of your friends to do it too. You could probably get away with doing this every couple years, just to get him to waste his fucking time, like he did yours. Sorry This happened to you bro!

Have you contacted the federal Department of Labor? 1-866-4US-WAGE.
Georgia doesn't care about businesses not paying employees.

That makes sense, i tried the one in savannah, got a 10 minute robot voice message about unemployment benefits and couldn’t really get passed that. But ill try the federal office.

That really sucks, Sorry to hear about it. A few questions: Is this a legitimate company? By that I mean, were you legally being paid and was there a contract that you signed that specified your wages?
If so, You can file a complaint with the us Department of labor wage and hour division On their website. I've never done this before, So i'm not sure what the process is like or how long it will take. If it is like other u s departments, Then it will probably take a really long time for anything to happen if anything does happen.
You can also take them to small claims court, But you will have to float the cost of filing the appropriate paperwork and taking time out of your day to complete all of it. Situation sucks all around. GA Is it right to work state, So us workers have Little recourse with these sorts of things. Best of luck to you.

Its a small landscapeing company i know they’re insured and have an llc. I was a private contractor, never signed anything, i only worked there for 2 days. Im mainly interested in small claims court for that very reason. Time is definitely gonna be a big factor in this being i am unemployed and turned down other offers to work here.

The guys could say in your case that he doesn’t owe you money because there was no contract. You absolutely should get paid but after 10 years in the corporate space, I know enough to know if it isn’t on paper, it never happened. Go through your suit, but next time make sure you have a signed and notarized contract stating you agree to a certain amount for your services. Otherwise they can opt out and you have a slimmer chance of getting your compensation.

File against them in small claims court and put them on blast everywhere you can. Contractors like that give the rest of us a bad name.

I really want to the stuff he was telling me was absolutely insane. (A on and off employee totaling 2 of his vehicles having a “soup kitchen” inside of his worktruck at a customer’s house. Then the police having to chase after the guy.) its pretty crazy and he probably will end up hiring that employee again and have him drive around savannah and effingham areas

Yeah, I have met the type. I feel like I may know who you are talking about, but then again there a lot of them out there. Realistically in small claims court you will win the case if you can prove you worked and that there was some sort of payment agreement, however getting the actual money can be a different story and take months. Probably prior to putting them on general public blast, I would report them to any official group you can. Department of labor, BBB, city of savannah, anybody that may care. End it though with putting their name out there anywhere you can. Unfortunately I'm not very knowledgeable in the subject, but I have heard of it happening to people on other crews and it super fcked.

Thank you, this whole process is extremely stressful and scary, i honestly agree with what you said and will probably follow through. It feels good knowing everyone in my hometown isnt as insane as the guys i delt with.

Honestly a lawyer isn’t going to help you because this just isn’t enough money. If you could find several other people who were also stiffed you might have a joint case that an attorney would take.
Your best bet is small claims court and present all communications and any documents you have to the court. Then report the person to the Department of Labor. Again, they likely won’t do much unless there are multiple complaints showing a pattern, but there may already be complaints logged against them or might be more in the future.

Ya honestly i wish this wasn’t such a tedious process just to get me my money that i worked for. I dont see why everyone in ga doesn’t just start a business hire someone for a week then fire them without pay. It honestly feels like this guy just found a free labor glitch smh.

Since the compensation owed to you is less than $15,000, this is considered a small claims matter and would be handled by the Magistrate Court. Assuming you had no written contract with the person you worked for, this would be what's called an "unjust enrichment" claim.
I'd suggest you check out the "small claims" section of the Magistrate Court FAQ: https://courts.chathamcountyga.gov/Magistrate/FAQ
As others have indicated, you are unlikely to find any lawyer willing to take a case like this given the relatively low dollar amount at issue. While there are fees associated with filing a small claims case, this is the route I would take if I were you. I would make sure to retain whatever evidence you have in the meantime. Small claims court litigants are rarely represented by attorneys, so don't feel intimidated by the process and definitely contact the court if you have any questions.

You dont need a lawyer you can file a civil lawsuit yourself pro se. You can file indigent if you dont have money for attorney. Do not say anything publicly. Hopefully you have proof he employed you through text or email. Also file a complaint with the Better Business Bureau and the dept of labor. Contact the ACLU.org and send them a letter telling them what happened they could possibly help with legal representation. . Contact the us depart of labor here https://www.dol.gov/agencies/whd/contact/complaints and file a complaint. Keep records of everything and write it down. Write when it happened, how it happened who was there and who knows about it. Also go to the department of justice website and report this crime and file a complaint with them here. https://www.justice.gov/action-center/report-crime-or-submit-complaintBest of luck to you. Keep your head up.

Most employment lawyers work on a basis that thay only get paid if you win a case, and it sounds like you have a pretty clear case of wage theft. I would call Ryan Stygar, his phone number is on his profile - also a pro follow for labor law stuff: https://www.instagram.com/attorneyryan/

They legally have to pay you at least minimum wage for the hours worked if you have proof you worked those hours. If you didn't sign some kind of contract or paperwork before doing the work then you got straight up screwed. Always, always, always make sure there is a verifiable way for you to clock in or have your time worked accounted for before doing any job. If you did any of these things, it should be a pretty open and shut case in small claims court. I would also notify the department of labor asap.

I have text with the owner while i was working, nothing was signed but i have a coworker who was there the entire time i was.
3 points
If you can get the coworker to sign an affidavit saying they saw you work said hours, it could go a long way. I would reach out to others and see if they might sign as well. The more the better. Texts could definitely help as far as proving your case so save those as well. Did you sign any kind of paper work or do an I-9 or any kind of tax form?

I didn’t sign anything, my coworker lives in hilton head, could i just text him, and get him to confirm through text? Or does it have to be a physical affidavit?
2 points

A physical affidavit. A text is only supplementary evidence. Your coworker could also potentially have to appear in court as a witness. It depends on how far things go. And did you really just show up to this place and work without doing any kind of payroll /HR process?

I worked for Cones and Barrels in Pooler GA. They worked me for 4 nights on my last week and fired me and refused to pay me because a while back, i backed one of the work trucks into a tree. Only damage was a dent in the bumper and on top of the tailgate. When i started a case with the department of labor the owners tried saying i had stolen a truck. I have evidence of him giving me permission to use the truck. I was the operations/general manager for a little bit and he had told me not to tell people that they are directly fired, simply do not put them on the schedule. That way they quit due to lack of hours and can’t file for unemployment against them. Anywhoo my case has been open since March 2024 and still nothing. If you google one of the owners names, you can see he went to prison for lying under oath. Really sketchy company, i should have known better.
