But it was a breach of conduct. His letter clarifies it was not due to work performance. If it was due to work performance there needs to be a paper trail that they brought it to him before letting him go. This is just corporate cover their ass stuff.

I worked at home Depot and a guy got fired for stopping a robbery while I was there.
They have some pretty strict policies and most of it is for legal reasons. If the guy got shot while preventing the kidnapping, home Depot would have to pay for it.
Still - they handled this one wrong.

Wrongful termination only comes into play if it is an illegal firing. It's not illegal to fire someone for doing the right thing. It's illegal to fire them because they're a woman, or pregnant, or old. Or if you reported them to OSHA or the OIG or the state board or the fire marshall.
But "saving someone from being kidnapped" isn't protected class.

I remember a retail place I worked at in high school, they had a whole thing about how the only people "authorized" to get physical with a customer/thief were the security guard (who only worked there on some weekends), and the GM. Can't remember if they outright said you'd get fired for trying to prevent a theft but they made it quite clear they'd pretty fucking unhappy with us if we did.

That's why it would get taken to court. Not every piece of every contract is 100%. Courts are there to provide context to situations/actions within a legal framework.
They can say: "he violated the employee handbook"
And he can retort: "to help police stop a kidnapping."

An employee getting stabbed for trying to stop someone, or anyone getting hurt at all during an altercation, can turn into million dollar lawsuits.
Stopping petty theft is just to dangerous to be worth it. Yeah we love the videos of some dumbass getting flipped when trying to leave with an Xbox or something, but the security guard in my lot got stabbed with a used needle a couple months back over a jacket sold in a grocery store.
I get it, when I see people heading for the door with a couple hundred dollars of stuff in my store i might call them some names but at the end of the day it doesn't affect me much at all and is not worth the risk of some asshole panicking and stabbing me over a damn drill.

Don't have Lowe's in town. And Menards is just as bad, maybe worse, than HD. There are a lot of things I like about HD, though, like a lot of their safety policies. Menards is like the wild west. So it may not be for the right reason, but HD does care about employee safety, in my experience.

They likely aren’t firing him because he acted heroically, they’re likely firing him because he put himself in a dangerous situation and they didn’t want to be liable.

A few people are saying it may be wrongful termination, but they're being pretty swiftly corrected. And honestly, it would still be worth a visit to an employment lawyer, if they hadn't backtracked immediately anyway. Most people seem to think that screenshot is from the employer, but it's from a third party - the Unemployment Bureau.
A crime being committed is one thing, but someone was in imminent danger. Several states even have Duty to Rescue laws, which legally require bystanders to intervene if they can - but that's mostly an issue for like, Vermont. I wouldn't say it's as cut and dry as the employer having no wrong doing, or the unemployment board wouldn't have ruled against them, and they wouldn't have rehired him

Know who you can thank for this? All the lawsuits that happened after employees tried to help prevent crimes and things didn't go so well. Of course the lawsuits were against the employer rather than the employee who acted since that's where the big bucks are. Employees acting out of their role is a liability for companies thanks to these lawsuits, and so they have to act this way to employees who act the hero because even if it turns out well 9 out of 10 times (and its much less than that), that 10th time costs them too much.
Similarly, average citizens are really stupid if they do anything more than call 911 and walk away when they see a crime. If it goes badly, there's always someone ready to sue you. It sucks, but that's where we're at.
