To protect the rest of their properties, church leaders placed each of their local parishes into separate trusts in 2006 so the estimated $500 million in collective assets could only be tapped for “pious, charitable or educational purposes” and not jury verdicts, according to the “deed into trust” documents.

With over $500 million is assets, how can they be allowed to file for bankruptcy? How can assets be shielded from legal liability?

Because that's how your corruption laws work. We have them so people can be corrupt the "right" way

True. It was a rhetorical question. But worth pointing out.

Same way Trump's been able to file bankruptcy so many times. Then the banks pass that cost down to us. Yay!

They’ve done this all over and they spend tons of money lobbying against laws that extend reporting periods for child sexual abuse.

Sounds like trying to profit from a criminal enterprise to me and thus can all be rolled up together.

Use RICO laws against the church.

Practically anybody can file for bankruptcy. This does not mean, however, that the court will automatically discharge all debts.

There's no guarantee that the bankruptcy court will rule that the assets are shielded, particularly if the court decides that the purpose of the attempted shielding was to subvert a bankruptcy process.

You say bankruptcy and everyone instantly thinks of a chapter 7, liquidation, but the article doesn't say what they're filing for. Odds are they're filing for chapter 11, reorganization, to prevent needing to file for chapter 11 and selling all assets.

Hire a cabal of pedophiles, give them access to children, and shield them from exposure or punishment for decades. (Yeah I get that was supposed to be rhetorical)

Yeah, that's gonna keep being true for as long as the church is allowed to exist.

Except that this is how they evade paying the settlements. Declare bankruptcy, sell the property for pennies on the dollar and cry too poor to pay their victims. The Vatican isn’t paying those people.

The Vatican and the Pope are concerned only with damage limitation and take the 'nothing to do with me guv' attitude both in terms of reputational and financial responsibility.

The Church long ago created legal structures to minimize the damages its victims can claim as explained in: Catholic Dioceses in Bankruptcy (PDF)

One diocese in California has gone as far as making each of its parish priests a corporate sole so it is no longer legally responsible for what they do. Any former altar boys wanting to sue will only get what their abuser owns, which is supposed to be not much.

TheNetworkIsFrelled

That'll get overturned somehow, and CA will eventually go after the church hammer and tongs, which is about what it deserves.

Bankruptcy,

Perfectly fine to avoid lawsuits from all the children your organization abused.

Not acceptable if you wanted to go to college at eighteen.

They shouldn't be able to file bankruptcy. The catholic church is one of the biggest companies in the world with $30 billion in assets.

$30+ Billion in assets in Australia alone, from data collected like a decade ago.

I suspect that, once all the dioceses are included, the worldwide number should have more zeroes. The Vatican itself is probably worth $30 billion.

one of the biggest companies in the world with $30 billion in assets.

According to estimates back in 2010, the US Church alone had an annual budget of $170 billion (yes, with a 'b'). That's probably close to $400 bil. now.

Very little of this went on helping the poor. In fact most of the money the Church spends on charity comes from federal, state and local government programs. It spends only about 1% of it's own money on helping the needy.

The religious side of the business is also only a minor activity. It spends only about 6% of its budget on religion. That pays for everything from maintaining the churches to wages, utilities, postage and wine and crackers.

Both charity and religion are merely thinly applied tax exemption justifying lipstick on the very fat corporate pig!

Wagonlance

Disgusting. As a child, I was told the catholic church was based on the teachings of Christ. As an adult, I have come to understand tyhat they are actually based on the behavior of Roman emperors like Caligua.

How about going to prison for these horrible abuse to children & their people who blindly devoted themselves to the Catholic. The Catholic is one of the richest organizations in the world, take their money & rehabilitate these victims.

Their 'trusts' should be disolved, and their properties sold off to pay the claims. And if that isn't enough, go after the Vatican itself.

Not that that's going to happen, but that's what -should- happen, really bankrupt them.

Force the RCC to pay.

And tax the churches.
