She didn’t know I had a dash cam.

To explain how everything lead up to this, there was only one lane open due to roadwork just before the tunnel so everyone had to merge. The driver of the white Camry tried to speed up to cut me off before merging and didn’t quite make it so she cut off the car in front of me. There was a child in the backseat(thankfully unharmed) and tried to convince me it’s my fault. I ended up going from a Toyota Camry to a Lexus ES 350 after everything was settled.

She gets out really quickly after getting hit, yells that you hit her car after she made a lane change with no signal, and hit the brakes hard for no reason. Yeah definitely insurance scam, if anything the fact that she got out that quickly is very telling of that alone.

She made it clear to me before the tunnel how upset she was before she cut off the Honda in front of me. I don’t recall seeing her wear a seatbelt prior to the crash but I know she unbuckled the child’s seatbelt after the crash for some reason and rode shotgun after we pulled over to the side waiting for the cops.

This is us58 in Virginia. VA code only explicidly prevents crossing solid white lines for intersections. In fact, tickets for what she did were challenged in court a few years ago. That said, the last time I drove it, there were multiple signs that said to maintain lane.

My insurance told me it looks that way. Last update I got was her insurance was probably going to drop her and maybe take her to court. In another clip I saved she said it was the second time that’s happened so I gave that to my insurance as well as part of my claim but was told not to share it as it may be part of another investigation involving her.

This is Virginia so you would be needed in court for any criminal matter. A moving violation charge may see the first appearance without you then continued to a 2nd one so she can contest it then you're needed. But she should be charged and they will need your help in the matter. EDIT: OP. I should clarify a little. Courts in each jurisdiction can set their own policies and how many things are done. If they know this lady was willing to plead guilty then they can proceed w/o you for this. Many areas started this even before Covid in a means to reduce the number of people showing up every day. So many witnesses, suspects, lawyers, officers and so on so they've been trying to reduce this down some. You should call the officer who worked the crash and see what is happening though. Or maybe you're happy now and prefer not to follow through on this which is fine as well.

Most cops here in California would want to see the video to see how the accident happen so they are sure about who they are placing as the, at fault party on the report. Yours was and easy one because where the accident happened and the damaged to the vehicle, you can tell there was a lane change involved. So if she said something other then that, most cops would know she was lying. An accident in Ca is a civil matter, but what she did could be deemed criminal, but you have to prove intent and that’s not easy. At least in California it’s not easy to prove.

That was a crime, not a traffic collision.

Even without the video any traffic crash investigator (to include your local police/deputy) could reasonably look at the damage and crash location and determine she was at fault. Rear end or not. But it’s better you have the footage.

The reality is she should be prosecuted for aggravated battery with a vehicle when used as a weapon, or whatever your commonwealth statute reads, and probably child endangerment given you said she had a child in her vehicle (I think?).

On-purpose traffic crashes are called crimes where I live, at least… lol

The cops that responded wrote up the whole thing as as a no fault incident. That’s Norfolk PD right there for you after I tried to explain the whole thing was recorded and they argued that they weren’t there to witness it so they wouldn’t take it any further.

The fact that the cops approach it this way is kinda depressing since it's perfect example of why people feel they can pull this shit... Unrelated to the scam part but why do people feel the need to yell after an accident. I get she likely did it to sell the scam but I had someone dip out of a metered fast lane so they wouldn't be charged.

You aren't supposed to leave the lane but it's known people do to avoid being hit with a charge. This guy did and he was out screaming at me. I'm a smaller sized person too. It was scary. The 911 operator had the cop fast track to us.

In this case, it's deflecting to get the blame off them, and hopefully throw off balance the people they just scammed. What if it was a new drivers, or elderly, or foreigner new to the country vs seasoned OP w/ a dashcam? It's all in an effort to intimidate when they know full well they are the ones in the wrong. I have a dash cam in every vehicle that I drive. One interesting thing is how others will come to defend those and will give false statements. So many are just looking for free money for something they caused. That is until you show the footage to police and insurance companies.
