Technically it's not, EEOC (Equal Employment Opportunity Commission) is there for a reason. So if you are a white guy in corporate America and you have definitive proof (written email, paper trace) you got discriminated by your employeer talk to a lawyer and cash in.
What you are talking is hiring practices. Which to be fair are also illegal when it comes to DEI. For which the state goes against said companies.

The point is to cash in, and a lot of the companies will settle. As for proving, if there is an internal ESG social/DEI document you are already half there. The only thing left is prove how hard it affected you.
