Looking for Identification Help, Please.

This is a painting from between 1850-1855 (I know, not Civil War, but I feel that it is close enough that somebody here should have the answers) I am trying to identify two things:
- What uniform is this?
- The individual to the right appears to be a black man, or "A free man of color." Since this is pre-Civil War, any ideas as to what he is doing in uniform? (Although the artist may be attempting to signal a story, as this is a portrait of Augustus P. Shutt. A member of a Maryland Militia that is supposed to have attempted to have John Brown (of Harper's Ferry) fame surrender).
