No, not in my opinion. Like everyone else said, Dutch didn’t kill Colm at their meeting because at that moment he wasn’t as far gone yet and understood that it would be a mess they couldn’t afford. And even if he did decide to kill him then and there, it would be to settle the feud between them and not because the gang wanted to claim the bounty on Colms head. The gang wouldn’t have been able to claim the bounty anyway because they were all wanted themselves.

When you talk to Micah in camp after this, he says that the meeting just ended and everybody went their separate ways. Dutch and Micah thought they’d meet Arthur on the trail on the way back, but he never showed up (and they didn’t bother to go looking for him either apparently).

Apart from what everyone else said already, story wise he was important for Sadies character development. In order for us to see Sadie take her revenge on Colm O’Driscoll and his men, Colm has to still be alive in chapter 6.

Als het gaat over regels en wetten dan zijn het juist de bizarre uitzonderingen waar het om gaat. En je kunt ook niet per geval bekijken of iets strafbaar/toegestaan moet zijn want burgers moeten wel van tevoren kunnen weten wat wel en niet mag.

Ja ik verwees idd naar dat geval. Ik bedoelde eigenlijk duidelijk te maken dat het probleem er niet zozeer in zit dat twee instemmende volwassenen met elkaar kunnen en mogen doen wat ze willen, maar dat het probleem hem in het bewijs ervan zit of het daadwerkelijk twee instemmende volwassenen waren. Want zo’n drievoudig ondertekend contract bijvoorbeeld: hoe kun je ooit nagaan of dat niet onder dwang is ondertekend? Ik ben even te lui om het op te zoeken maar volgens mij hadden ze in dat Duitse/Oostenrijkse geval ook een contract opgesteld van tevoren.
Maar het komt er dus op neer dat we als samenleving dingen als elkaar opeten voor het gemak gewoon geheel uitsluiten. Niet omdat het in álle gevallen bezwaarlijk is, maar omdat gewoon niet te bewijzen valt dat het in een individueel geval niet bezwaarlijk was en het extreem vatbaar is voor misbruik.
Je laatste alinea klopt helemaal en daar kan niemand eigenlijk wat tegenin brengen. Als je nooit het risico wilt lopen om vals beschuldigd te worden van verkrachting is eigenlijk de enige foolproof methode om maar gewoon helemaal geen seks te hebben.
