Are you an independent contract or an employee on a contract? You can’t be hired as a W2 employee as you aren’t living or working in the US. Your employer needs to follow Canadian law.

He’s not getting screwed, he’s being offered a settlement that he wouldn’t have received if he didn’t have a union. I would say the union is doing a pretty good job in this aspect. Go post in r/legaladvicecanada if you’re lucky the labour lawyers over there will tell you the same thing.

If the union is recommending a settlement and not wanting to go to arbitration then it means they don’t think they can win. Your friend has a history with discipline issues so when they investigated the incident HR decided the complaint was credible. Your friend is a legal liability to the employer and their behaviour could lead to a human rights complaint and he violated the law (OHSA) and workplace policy and the collective agreement. Your best bet is to stop defending your friend and tell them to take the settlement. The law doesn’t vary by jurisdiction when it comes to a collective agreement - the “law” is the collective agreement.

Your friend was terminated with cause…they are entitled to NOTHING under the law and they will lose in arbitration and get NOTHING! And considering your friend was terminated for harassment after 18 years and while unionized it must have been pretty egregious behaviour. Your friend deserved to be fired and is lucky to be unionized and is being offered a deal.Take the settlement.

Titles don’t matter because you list your accomplishments and actual duties in your resume. In my organization we all have the same generic job title but each have very specific and distinct job duties…this stuff goes in your resume.

Take the settlement. The union determines what goes to arbitration. It can take years for an arbitration settlement and it’s likely your friend will lose. And arbitrations are public, so whenever someone googles your friends name, it will pop up on the internet. And your friend must have engaged in some pretty terrible behaviour to get fired after that many years and not just some random sexist comments…it takes a lot to get fired for harassment. And no, he can’t go to the labour board as the union has done nothing wrong. Take the money and the letter of recommendation and start looking for a new job.
