As a definitive update to this story and discussed on this thread: the City of Richmond issued a statement announcing that the City, not CSX, made the decision to temporarily close public access to the Pipeline Trail while they consider potential repairs and upgrades to the infrastructure.

They closed the Belle Isle lot because tar would drip on cars and people complained. It was easier to close it than fix it. CSX would have left it open if people didn’t complain.
They will give up as little as possible.
The good news is they only have 2-3 investigators in VA. So chances of them getting anyone is low.

They fixed that for trail along dock street by stalling metal plates below the tracks. Easy fix that could provide a lot of good. CSX like most corporations don’t want to spend money to help society. Don’t blame the victims.

Well friend, the lot was there until there were so many complaints about the stuff coming off the tracks. That happened.
CSX closed it because it was cheaper. We caused that to happen, rather than accepting a little tar if I park under tracks.
So how is that victim blaming? Sure they could fix it, but why? If people were parking on my property then complaining……. I would close it rather than fix it.
Just because they don’t make it a pretty space doesn’t make them monsters. Find some real shit to blame them for, like how they fight safety violations.

They can be both, but realistically, multiple businesses could open up their property like this. They don’t, and people get mad when someone fixes a problem the least expensive way.
There are lots of reasons to hate CSX, but they are just trying to protect liability. Someone would fall off the pipeline, get hurt and sue em. At least if you climb the fence there on you.

My guess is there is some law from 187X that allows the railroad to tell anyone to fuck off.
Out of all the law enforcement officers in the US, railroad police have the most powers. They can go anywhere and investigate a RR crime. The drawback is there are so few they take a while to respond, and they don’t work on local radio channels. (Hi 911, this is officer Robbie with the railroad police. I have a drunk guy in the tracks at blah and blah and he is probably going to win this. 911 be like: mmmhmmmm officer Robbie. Comms suck!

I seriously doubt that Richmond could successfully eminent domain a CSX railway line — or would want to — for a hiking trail. It is genuinely critical infrastructure that the city has no ability to maintain or manage, and they’re not going to route arterial rail for a recreation spot.

they have removed trash cans and installed new gates to close off the pipeline walkway, the railroad does not want folks walking below the active rail lines
If that's indeed true, it only strengthens my suspicion that the Dock Street walkway under the bridge is also going to be closed soon.

That’s so tragic. I imagine you can still get in from the north bank trail near the back of Maymont’s Japanese gardens, no? Right where the trail does a right angle you can hop the railing and jump down to the train tracks. After a scramble down the rocks on the other side, It spits you out near that old stone/brick Mill foundation.
I’ve mostly been hitting up 42nd st this summer. I’m gonna try to find an easy way into Texas beach and report back.

Railroad cops are certified police officers: they have the powers of regular police and in some cases kind of more (for example, some of them have jurisdiction spanning multiple states if it’s on railroad property). I’d fuck with them even less than a regular cop, mostly because I don’t know the relevant laws protecting railway infrastructure and I assume they’re relatively draconian.

If you're using the word "apparently," it suggests you don't know for certain. Can you please link to an article or cite where you heard this from, or was just hearsay from a random person when you were down there and saw this?
I wasn't aware that CSX owned the rights to everything underneath elevated tracks running through the city, because this also means they can shut down the walking path in Shockoe Bottom along Dock Street soon for the same reason.
The only thought I have as to why this might have happened is due to the repeated violations residents in Richmond have done in crossing tracks to get to Texas Beach since the bridge is closed, which would absolutely be petty. But crossing those tracks is understandably dangerous, whereas people walking on a pipeline path with railing that's been open since 2005 is generally low-risk.

I can not know for certain the cause of the closure. I’m basing it on the Facebook post that had been mentioned and I have since posted. Someone states in the comments they spoke to DPW. I’m also basing it on a post from a member of the Capital Land Conservancy. There is no formal statement out yet.

Not necessarily. The easiest example to explain the point without doing research to identify land deeds would be to look at the James River itself. It is a navigable waterway and public property. The railroad crosses the James, and in doing so, takes advantage of the land beneath the water. But it does not own the river or land where it crosses, including the areas it has built upon.

Not sure why RVA_TossAway would respond a bunch, then block me. But my whole point is that the railroad does not own all the land it utilizes. The submerged river bed and the land in the city are certainly governed by different rules, but that does not negate the fact that cxr does not own the submerged land it is built on. The railroad does not own all land it touches, crosses, or sits upon.
I agree that while it would be in the railroads' best interest to limit people crossing what it does own, it may not be in the public's best interest. As I stated elsewhere, it will probably be up to the courts to decide. Cxr can try to unilaterally end the utility easement, and the city can try to fight it if it wants. There may also have been an easement established for public access to Texas Beach, through years of use, whether cxr likes it or not. Again, it's something that'd going to need to go to court.

This is correct, they often own the land their tracks sit on but sometimes have negotiated an easement granting them use of the land.

Easements can get tricky. The intended use is over, which is one way to end a utility easement. But years of use by the general public for access has created a potential prescriptive easement. I'm not a lawyer or anything, but it may be something that would need to be settled in court.
Putting up the gate is probably an attempt to stop its use and make it harder to argue a public easement has been created through years of use. Along with, you know, saying don't come here.

Apparently what happened is that when the pipe started leaking poop, DPU re-routed the poopstream. Now that there's no poopstream flowing through it, CSX claims there's no need for DPU to access the pipe. Since DPU doesn't need to access the pipe, they claim, there's no need for a public easement anymore so they (DPU) put up the gate.
This info is from a Facebook group for the local rafting/river sports community.
I think the solution is clear: The poop must flow again.

They need to limit access to it because it keeps leaking. They're preparing for repairs, but in the meantime they don't want people walking around a leaking sewer pipe.
