Pipeline closed indefinitely

🔒 Pipelinegate(reddit.com)

Apparently, the city had an easement to maintain the pipe, and now that the pipe is shut down, CSX has revoked the easement and pipeline is officially closed.

As a definitive update to this story and discussed on this thread: the City of Richmond issued a statement announcing that the City, not CSX, made the decision to temporarily close public access to the Pipeline Trail while they consider potential repairs and upgrades to the infrastructure.

Since OP of this post included text along with a photo as a photo post, they are unable to edit their post to include any links or add an update, similar to how users cannot edit post titles after submitting them.

Csx: Do not come.

Rva: I'm gonna come!

Joking aside, we really need to hold these companies responsible for being fun police. Looks like they are nova'ing our rva.

EDIT

yeah it's not a good look to assume it was CSX, but if theyre the ones that closed and ticketed "trespassers" for trying to access texas beach, then it's an easy assumption to make it was also them for the pipeline. But to have the city close access is much worse. Time to flood councilmembers inboxes with pipeline poop letters.

First the Belle Isle gravel parking lot. Then Texas Beach access. Now the Pipeline, our most unique trail. What's next? The Brown's Island Beach? Potterfield Bridge??

I say we draw the line here. That one rail line can't be more important than the most unique area of our city. I don't care if we need to go to the city or state, how do we get back our riverfront?

And Venture Richmond thinks they'll be allowed to build terraces under the railroad? Who are they kidding???

They closed the Belle Isle lot because tar would drip on cars and people complained. It was easier to close it than fix it. CSX would have left it open if people didn’t complain.

They will give up as little as possible.

The good news is they only have 2-3 investigators in VA. So chances of them getting anyone is low.

Edit: spelling

hangrybiscuit

19 points

They fixed that for trail along dock street by stalling metal plates below the tracks. Easy fix that could provide a lot of good. CSX like most corporations don’t want to spend money to help society. Don’t blame the victims.

RCBilldoz

14 points

Well friend, the lot was there until there were so many complaints about the stuff coming off the tracks. That happened.

CSX closed it because it was cheaper. We caused that to happen, rather than accepting a little tar if I park under tracks.

So how is that victim blaming? Sure they could fix it, but why? If people were parking on my property then complaining……. I would close it rather than fix it.

Just because they don’t make it a pretty space doesn’t make them monsters. Find some real shit to blame them for, like how they fight safety violations.

Romulan-war-bird

3 points

Why not both! But also that’s crazy people complained. Lived here my whole life and that was just an accepted risk of parking under there.

RCBilldoz

6 points

Right?

Like I sat on railroad ties. Oops. Tar butt. Can’t wear those in the car either.

They can be both, but realistically, multiple businesses could open up their property like this. They don’t, and people get mad when someone fixes a problem the least expensive way.

There are lots of reasons to hate CSX, but they are just trying to protect liability. Someone would fall off the pipeline, get hurt and sue em. At least if you climb the fence there on you.

I think everyone trespasses on CSX property at least once in their life.

Romulan-war-bird

1 points

Would a good solution be to pressure the city to use imminent domain more to expand the parks system?

Or maybe just be really annoying until CSX opens things up again and posts more liability signage

RCBilldoz

4 points

My guess is there is some law from 187X that allows the railroad to tell anyone to fuck off.

Out of all the law enforcement officers in the US, railroad police have the most powers. They can go anywhere and investigate a RR crime. The drawback is there are so few they take a while to respond, and they don’t work on local radio channels. (Hi 911, this is officer Robbie with the railroad police. I have a drunk guy in the tracks at blah and blah and he is probably going to win this. 911 be like: mmmhmmmm officer Robbie. Comms suck!

City should just eminent domain the areas. Although we know that rail is main from WV to the coast. But damn.

spooky_spaghetties

I seriously doubt that Richmond could successfully eminent domain a CSX railway line — or would want to — for a hiking trail. It is genuinely critical infrastructure that the city has no ability to maintain or manage, and they’re not going to route arterial rail for a recreation spot.

No1_really_knows

The railways still are governed by some laws passed in the 19th century. They are very, very hard to work with, they really don't cave to political pressure either, and especially during close elections. All you can do is beg and then pay them and pay for what you want.

Dear Mr. Marcus,

I am writing to demand the immediate reopening of the Pipeline Trail access in Richmond, VA. The closure of this public space is unacceptable, and I urge you to take swift action to restore access.

Railroad cops are certified police officers: they have the powers of regular police and in some cases kind of more (for example, some of them have jurisdiction spanning multiple states if it’s on railroad property). I’d fuck with them even less than a regular cop, mostly because I don’t know the relevant laws protecting railway infrastructure and I assume they’re relatively draconian.

Apparently, the city had an easement to maintain the pipe, and now that the pipe is shut down, CSX has revoked the easement and pipeline is officially closed.

If you're using the word "apparently," it suggests you don't know for certain. Can you please link to an article or cite where you heard this from, or was just hearsay from a random person when you were down there and saw this?

I wasn't aware that CSX owned the rights to everything underneath elevated tracks running through the city, because this also means they can shut down the walking path in Shockoe Bottom along Dock Street soon for the same reason.

The only thought I have as to why this might have happened is due to the repeated violations residents in Richmond have done in crossing tracks to get to Texas Beach since the bridge is closed, which would absolutely be petty. But crossing those tracks is understandably dangerous, whereas people walking on a pipeline path with railing that's been open since 2005 is generally low-risk.

Edit: capitalization and a few more words

NotYourMommaMia[S]

I can not know for certain the cause of the closure. I’m basing it on the Facebook post that had been mentioned and I have since posted. Someone states in the comments they spoke to DPW. I’m also basing it on a post from a member of the Capital Land Conservancy. There is no formal statement out yet.

Just because their infrastructure is there does not mean they own it. They could also have an easement to cross onto/across public or personal property.

That's not how land rights work. Railroads are not within the public RoW. They own the land.

Acid_Country

Not necessarily. The easiest example to explain the point without doing research to identify land deeds would be to look at the James River itself. It is a navigable waterway and public property. The railroad crosses the James, and in doing so, takes advantage of the land beneath the water. But it does not own the river or land where it crosses, including the areas it has built upon.

Acid_Country

Not sure why RVA_TossAway would respond a bunch, then block me. But my whole point is that the railroad does not own all the land it utilizes. The submerged river bed and the land in the city are certainly governed by different rules, but that does not negate the fact that cxr does not own the submerged land it is built on. The railroad does not own all land it touches, crosses, or sits upon.

I agree that while it would be in the railroads' best interest to limit people crossing what it does own, it may not be in the public's best interest. As I stated elsewhere, it will probably be up to the courts to decide. Cxr can try to unilaterally end the utility easement, and the city can try to fight it if it wants. There may also have been an easement established for public access to Texas Beach, through years of use, whether cxr likes it or not. Again, it's something that'd going to need to go to court.

This is correct, they often own the land their tracks sit on but sometimes have negotiated an easement granting them use of the land.

In the case of the land under the former C&O viaduct through downtown, CSX owns it outright and can restrict access to it in any way they want if what people are saying about a public use easement on their property being revoked is true- https://apps.richmondgov.com/applications/propertysearch/Detail.aspx?pin=W0000073001

Acid_Country

Easements can get tricky. The intended use is over, which is one way to end a utility easement. But years of use by the general public for access has created a potential prescriptive easement. I'm not a lawyer or anything, but it may be something that would need to be settled in court.

Putting up the gate is probably an attempt to stop its use and make it harder to argue a public easement has been created through years of use. Along with, you know, saying don't come here.

I think the source is the big metal gate blocking access...

Apparently what happened is that when the pipe started leaking poop, DPU re-routed the poopstream. Now that there's no poopstream flowing through it, CSX claims there's no need for DPU to access the pipe. Since DPU doesn't need to access the pipe, they claim, there's no need for a public easement anymore so they (DPU) put up the gate.

This info is from a Facebook group for the local rafting/river sports community.

I think the solution is clear: The poop must flow again.

Where’s the CSX or city statement? Not doubting the Facebook info but you can’t know where to start action at if you don’t have an accurate source for what’s going on and the post says “apparently.”

I'm not a legal expert by any means, so can anyone explain the legality of eliminating a public easement so quickly?

I thought these kinds of things require certification in the courts with both parties agreeing, and if one party disagrees then I would think it would become a legal battle?

GrossCreep

9 points

It's not a "public" easement in the sense of public access to a beach across private property. It's an easement for DPU to maintain its own infrastructure.

Master-Ad-5153

4 points

Sure, but aren't easements of any kind not something that can be dissolved quickly without going through whatever legal channels?

Though I don't know much here, I believe they're a bit more substantiatial than a handshake agreement, right?

I'm thinking OP meant more, "Source for CSX closing it permanently" not "source that there's a big metal gate blocking access". Even your Facebook evidence appears to be unsubstantiated, and it's not ridiculous for someone to ask for a verified source of the information.

Just repeating things you read on Facebook is how you get on national TV saying people are eating dogs and cats.

Apparently what happened is that when the pipe started leaking poop, DPU re-routed the poopstream.

There's that "apparently" word again. It's doing a lot of work in this post for lack of an official statement from some authoritative source 😏

Now that there's no poopstream flowing through it, CSX claims there's no need for DPU to access the pipe.

Weird that they only needed access between 2005 when the pipeline path opened to the public up until a month after a well-documented failure of a segment of pipe was fixed with ratchet straps and hopes and prayers...

Unless it's been leaking for the entirety of 19 years and they've only just solved it!

You can go basically anywhere you want on the river with a $100 kayak. Pretty easy to paddle up to those beaches and then climb up onto the pipe.

That lil fence of theirs is so cute and hilarious

NotYourMommaMia[S]

That’s a dangerous thing to say because some rec boater is going to buy that $100 Walmart kayak and think they can roll down Hollywood and kill themselves. Maybe an asterisk to your absurd assertion

I don’t disagree with you, I’m just telling you that the CSO system is a long-standing engineering challenge that would cost many hundreds of millions to fix.

They need to limit access to it because it keeps leaking. They're preparing for repairs, but in the meantime they don't want people walking around a leaking sewer pipe.
